AS PER ICAI RULES: An article is entitled to leave for a period equivalent to 1/6th of the total period served by him/her. Here period served is specially highlighted

As per this rule you can compute the leaves but keep the following in mind:-

1. It is the 1/6 of total period served and not 1/6 of total number of days:

for example:-

 Wrong method :-

you cannot calculate as (365×3)/6

this is wrong.

The right method is:

Case I

Total no. of days- say 365×3 = 1095

less: leave taken(other than weekly holidays), say 187

Actual period served would be 1095-187=908

entitled leaves= 908/6= 151

Excess leaves= 187-151= 36

Case II

A. Total number of days served = 700

B. Less: Total leave taken (other than weekly holidays) = 140

C. Actual Period served = 560

D. Entitlement of leave (1/6th of the actual period served) = (560/6) = 93

EXCESS LEAVE: (B-D) 47

Case III

A. Total number of days served (365 × 3) = 1095

B. Less: Total leave taken (other than weekly holidays) = 137

C. Actual Period served = 958

D. Entitlement of leave (1/6th of the actual period served) = (958/6) = 160

EXCESS LEAVE: (B-D) NIL
